What landlords need to know
The Government of British Columbia's most recent change to the Residential Tenancy Act occurred today, July 18, 2024. The update created a residential tenancy board web portal to create and provide the various types of evictions that may occur for a rental unit.
The portal will require a BCEID for login verification and an owner will need all the information required to complete the eviction process. This will include a firm contract of purchase and sale, should the owner request that a tenant move out for the owner's use of the property upon a buyer purchasing the property.
The process has many measures built to educate, inform, and warn owners about the potential risk of submitting an eviction notice that does not adhere to the rules of the residential tenancy branch. Tenants will have the right to file for dispute resolution as in the past should they feel that the eviction notice is invalid and choose to file for a dispute resolution hearing.
Although the process may be confusing for some, the step-by-step guide is straightforward to those familiar with the property and the details of the current tenancy in place.
A major benefit of the newly created portal is the confirmation of the deadline for serving notices to the tenants of the rental property. Many experienced REALTORS are unsure of the timeline required to ensure that notices are served in a manner that protects the tenant's rights. This deadline can vary dramatically depending on the landlord's preferred method, either, in person, by email, posting to the door, mailbox, fax, or mail.

The dispute resolution proceeding can be a timely, costly, and emotional situation for both owners and tenants, any steps that aim to mitigate this occurrence are a welcome addition.
